Notice and Take Down Procedures and Copyright Agent

Unauthorized copying or distribution of copyrighted material is an infringement of the copyright holder’s rights.  At our discretion under appropriate circumstances, Company may revoke the license of any party who infringes upon the copyright, or other intellectual property rights, of others.

If you are an artist or other copyright holder that believes that any materials accessible on or from the Website or the Service infringes your copyright, you may request removal of those materials (or access thereto) from the Software by contacting Company’s copyright agent (identified below) pursuant to 17 United States Code 512(c)(2):

Under Title 17, United States Code, Section 512(c)(3), you must provide a notification of claimed infringement related to the application in the form of a written communication addressed to the designated agent as set forth above and the notification must include substantially all of the following:

  1. A physical or electronic signature of the owner of an exclusive right that is allegedly infringed or person authorized to act on behalf of the owner;
  2. Specific identification of the copyrighted work that you believe to have been infringed or, if multiple copyrighted works are covered by a single notification, a list of each copyrighted work claimed to have been infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) of an authorized version of the work.
  3. Information related to the works reasonably sufficient for Company to promptly locate the work (e.g. title of work, location, etc..).  Please describe the work, and provide us with its URL or any other pertinent information that will allow us to locate the work.
  4. Your name, address, telephone number and (if available) e-mail address or other information reasonably sufficient to permit Company to directly contact the complaining party.

  5. A statement that the complaining party has a good faith belief that the complained of use of the work is not authorized by the copyright owner, its agent, or the law.
  6. A statement requesting that Company take a specific act with respect to the alleged infringement (e.g. removal, access restricted or disabled); and
  7. A statement that the information that you have supplied is accurate, and indicating that "under penalty of perjury," you are the copyright owner or are authorized to act on the copyright owner's behalf.

Any person who believes that their valid copyright rights may be infringed acknowledges that, if you fail to comply with all of the requirements of this section, your notice as described herein may not be valid.
